Photographs of Patients
We are creating a Departmental newsletter and want to take a picture of a patient about whom an article is being written. Do we need to obtain the patient’s written authorization to use and disclose her information?Yes. Using a patient’s information – including a photograph – for this purpose requires a written authorization. This use does not fall under treatment, payment, and health care operations; therefore a written authorization is required. The authorization should be placed in the patient’s legal medical record maintained by HIMS.
